WPThrust.com is a specialized catalog-based e-commerce and e-services website.
Definitions and Rights
Customer(s)/Client(s)/Consumer(s): Any individual, organization, or legal entity utilizing WPThrust services.
Parties: Refers to WPThrust and the Customer/Client/User/Visitor.
Personal Data: Defined by the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, it includes any information identifying a person either directly or indirectly.
Data and Information Rights: Customers have the right to review, rectify, edit, or withdraw their personal information from WPThrust’s database at any time during the contractual agreement.
Plugin: The WPThrust plugin for the WordPress content management system.
Service: Includes Support, Updates, and Plugin.
Support: Comprises assistance and maintenance services provided by WPThrust.
Technical Requirements: Hardware and system specifications recommended by WPThrust, which Customers must maintain.
Update: Improvements to existing application services accessible via the Service, provided as part of the Support service.
Scope of Application
These General Terms and Conditions of Sale detail the technical, legal, and financial terms under which WPThrust provides its Customers with a plugin for the WordPress Content Management System via www.wpthrust.com.
Acceptance and Enforceability
By using WPThrust services, the Customer acknowledges having read, understood, and accepted these General Terms and Conditions. Customers are reminded of these terms at the bottom of each order page. WPThrust reserves the right to revise these terms at any time, and revisions will be announced on the website. The version applicable to an order is the one in force at the date of payment confirmation.
Ordering
Creating a customer account requires a login and password. Customers are responsible for the confidentiality of their login details.
To place an order customers must follow steps on the website, including login, product selection, payment, and acceptance of terms. WPThrust reserves the right to cancel orders due to errors, omissions, or other reasons.
Products and Services
Features of each product are detailed in the product factsheets on the website.
WPThrust offers licenses for plugin use on a single website, three websites, or an unlimited number of websites, excluding use by web hosting companies on behalf of their customers.
A one-year support and update service is included with the purchase of a plugin license.
Receipt and Complaints
Receipt of products is completed when the customer activates the download link.
If activation keys are not received, WPThrust will issue a new one.
For complaints, customers should check their Spam folder for the activation email before contacting support.
Customer’s Cooperation and Obligations
Customers must ensure their hardware and systems comply with Technical Requirements and install recommended updates. They must provide the necessary information and cooperate with WPThrust for support services.
WPThrust Obligations
WPThrust commits to its best efforts in delivering the plugin license and providing quality IT support services. However, fluctuations in bandwidth and Internet service contingencies may affect service availability.
Price and Payment
Pricing is displayed in USD and includes GST. Prices may be revised at any time.
Payment is due upon order placement, with options including PayPal and credit/debit cards. Payment is irrevocable once made.
Cancellation and Termination
Customers who waive their right to cancel by downloading the Product immediately cannot cancel their order. Breaches of contractual obligations by either party may result in termination of the agreement after a formal notice period.
Warranty Disclaimer and Refund Policy

Liability
WPThrust’s liability is limited to the amount paid by the Customer when placing the order. It is not liable for damages from plugin use beyond one year after the order or for incidents unrelated to the Service.
Force Majeure
Neither party is liable for non-performance due to force majeure or unforeseen circumstances, which may include strikes, adverse weather, or Internet service interruptions. If such events last over three months, the terms of sale may be terminated.
Severability
If any provision is deemed invalid, the remaining provisions remain in effect. The parties may replace or amend invalid provisions.
Probative Documents
Entering credit/debit card details and confirming an order constitutes proof of the order and renders the payment due.
Personal Data
Personal data is processed for access to Products, invoicing, newsletters, statistics, marketing improvements, and customized offers.
WPThrust ensures the security, integrity, and confidentiality of Personal Data. Data may be provided to authorities to comply with legal obligations.
Customers have the right to access, modify, and delete their Data. They may oppose data processing for legitimate reasons and marketing purposes by contacting WPThrust.
Cookies
Customer browsing information is stored by cookies for up to 13 months. Customers may disable cookies in their browser settings, understanding this may restrict website use.
Intellectual Property
WPThrust owns the intellectual property rights to its website content and products. Customers may not reproduce or download content without prior authorization.
Governing Law and Jurisdiction
All conflicts and controversies concerning the General Terms and Conditions of Sale & Service shall be adjudicated under the purview of Indian laws and fall within the exclusive jurisdiction of the courts located in Jaipur, Rajasthan (India). Disputes involving trading customers shall be addressed by these specified courts, whereas disputes involving non-trading customers shall be resolved under the pertinent jurisdictional statutes and legal provisions.
